Rights to light

Our client was wanting to buy a Chelsea townhouse recently renovated by a developer. Unfortunately the developer had extended the property so that it blocked the light from a neighbour’s window. Our client needed advice as to whether this issue was a ‘deal breaker’ or whether it could be simply resolved.

We enlisted a team to assess the situation for the client: a ‘right of light surveyor’ , a lawyer and a QC. Ultimately, they advised the client that the risk was too much, mainly because the person affected was not interested in reaching an agreement with the light situation as it was.

Subsequently we have advised on other rights of light issues where temporary offices were significantly blocking the light into a public building.
